Is a Protection Order the Same as a Domestic Violence Protection Order?
Yes, a protection order is another term for a Domestic Violence Protection Order. It is also referred to as a 50B Order, DVPO and restraining order. A protection order is issued by a North Carolina district court to protect victims of domestic abuse. A protection order is intended to provide a higher level of protection for the victim by prohibiting the alleged abuser from doing specific things or taking certain actions.
A protection order may prevent the alleged abuser from:
Coming within a certain distance of the victim
Purchasing a firearm
Engaging in specific activities or actions that would give the abuser a chance to interact with the victim
Living in the same household as the victim
Having any contact with the victim in person, by telephone or other electronic devices
Depending on the facts and circumstances of the case, the protection order can have a significant impact on other family court decisions concerning property division, custody and support. For example, the court may order that the alleged abuser must vacate the marital home and visitation with children must be supervised. In extreme cases, the court could order the alleged abuser to attend counseling or seek other treatment. Violating a protection order can result in a Class 1A misdemeanor charge. The abuser could face up to 12 months in jail if convicted.
