How Much Does A Divorce Cost?

Going through a divorce can be a traumatic and emotionally painful process for all parties involved; however, it can also create financial difficulties for the parties. Going from a dual-income family to a single income household is never easy. Many people feel as if they cannot afford to get a divorce but they have no other alternative to end the pain and frustration of a bad marriage. Even when both parties agree as to all issues involved with the divorce, they still worry about divorce cost and how they will pay the attorney fees.

Paying for a North Carolina Divorce Action

Unfortunately, it is virtually impossible for a divorce attorney to quote an exact fee for a divorce without meeting with the person first to learn more about the circumstances that are involved in the divorce. Many factors are involved in a divorce action. Each of those factors can affect the cost of the divorce.

Some of the factors that affect the cost of a divorce including but are not limited to:

  • Whether the issues associated with the divorce are uncontested or contested

  • Whether there are children involved

  • The type of marital debt and martial assets to be divided

  • Whether the marital debt and marital assets are in dispute

  • Division of retirement accounts, business assets or other complex assets

  • Alimony and child support issues

  • Discovery costs, expert fees and other costs associated with contested issues

  • The amount of time involved in settling or litigating the divorce

Because North Carolina is a no fault divorce state, the parties are not required to prove “fault” such as adultery or spousal abuse in order to obtain a divorce. The parties only need to live separate and apart for one year in order to be eligible for a divorce. Because spouses do not need to prove fault, divorce costs in North Carolina can be lower when compared to divorce costs in states that require parties to “prove” one spouse was at fault for ending the marriage.

Obviously, it is in the best interest of both parties to settle matters outside of court because this will lower the divorce cost. It is also in the best interest of the parties and their children if they can settle their differences without the necessity of going through a long, painful litigation process.
